    To impose a temporary moratorium on certain airline mergers and 
                             acquisitions.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Airline Merger Moratorium Act of 
2001''.

SEC. 2. TEMPORARY MORATORIUM ON CERTAIN AIRLINE MERGERS AND 
              ACQUISITIONS.

    (a) In General.--In the 1-year period beginning on January 1, 2001, 
it shall be unlawful for a major air carrier to acquire assets or 
voting securities of another major airline carrier if with respect to 
the acquisition notice is required to be filed under section 7A of the 
Clayton Act (15 U.S.C. 18a).
    (b) Definitions.--In this section--
            (1) the terms ``air carrier'' and ``interstate air 
        transportation'' have the meanings given such terms under 
        section 40102 of title 49, United States Code; and
            (2) the term ``major air carrier'' means any of the 8 air 
        carriers that account for the highest number of scheduled 
        revenue passenger miles in interstate air transportation, as 
        determined using data from the latest year for which complete 
        data is available.
