These days, the police can charge someone for distracted driving if they can assume the person was using/glancing at a detached phone. Of course, I would assume that they take other factors into consideration before making that conclusion: whether the phone is detached, whether a call was in progress at the time of accident, etc. I think there are a lot of people getting away with using their phones with one free hand while driving.
