Your reasoning is as good as mine, but neither has been tested really. My take on it is that policy complaints on echomail matters can be invoked by a moderator if nicely asking, and after that not so nicely asking (followed by the 'Italian Victory Salute' aka 'the george bush sign' probably) doesn't work when moderating where-after said moderator could become annoyed enough to seek help and file a formal complaint, not on content, but on the technical ground of being prevented from performing his/her moderator job. At that point a minor technicality comes into play ...
